Dr. Prabhash Ranjan, Assistant Professor, South Asian University, New Delhi, will be speaking at Panel Discussion I: “The Changing Face of Investor-State Dispute Settlement: Is There An Ideal Model?” on October 15, 2016.

Dr. Ranjan teaches and publishes in the area of international investment law and world trade law. He has been an Associate Professor at National Law University, Jodhpur; Assistant Professor at National University of Juridical Sciences (NUJS), Kolkata; Visiting Scholar at University of Sydney; Young Asian Scholar at National University of Singapore (NUS); Guest Tutor and Lecturer at King’s College London; and Research Consultant to United Nations Development Programme (UNDP). He was also a member of the Sub-Committee set up by the Law Commission of India to study the 2015 Model BIT and has contributed to its 260th Report on “Analysis of the 2015 Draft Model Indian Bilateral Investment Treaty”, August 2015.

Dr. Ranjan will be discussing the Indian Model BIT: Investor-State Dispute Settlement provisions and the local remedies exhaustion compulsion.

Mr. George Pothan Poothicote, Advocate and Consultant, Ministry of External Affairs, will be speaking at Panel Discussion I: “The Changing Face of Investor-State Dispute Settlement: Is There An Ideal Model?”on October 15, 2016.

Mr. Pothan is currently appointed as Legal Consultant to Legal and Treaties Division, Ministry of External Affairs, Government of India, New Delhi. Mr. Pothan completed his LL.M. from King’s College London in Public International Law with a special focus on International Commercial and Business Laws, including International Commercial and Investment Arbitration. He was a member of the Sub-Committee set up by the Law Commission of India to study the 2015 Model BIT and has contributed to its 260th Report on “Analysis of the 2015 Draft Model Indian Bilateral Investment Treaty”, August 2015.

Mr. Pothan will be discussing the UNCITRAL Investment Court System Proposal and its consequent adoption in the Canada-EU Comprehensive Economic and Trade Agreement (CETA) and the Transatlantic Trade and Investment Partnership (TTIP).

Dr. Aniruddha Rajput, Advocate, Supreme Court of India, will be speaking at Panel Discussion I: “The Changing Face of Investorstate Dispute Settlement: Is There An Ideal Model?” on October 15, 2016.

Dr. Rajput is India’s Candidate for the United Nations International Law Commission (2017-21). He is the Additional Advocate General for the State of Jharkhand in the Supreme Court of India and a Member of 5th Haryana State Finance Commission. Dr. Rajput has been practicing in the Supreme Court of India with focus on arbitration, public law and commercial litigation. During 2010-12, he was Visiting Professor of International Commercial Arbitration and International Trade Law at the Indian Law Institute. He was involved in drafting the Arbitration and Conciliation Rules of London Court of International Arbitration (India) and Delhi High Court Arbitration Centre. He also participated in consultations for amendments to Indian Arbitration & Conciliation Act, 1996.

Dr. Rajput will be discussing Trans-Pacific Partnership investor-state dispute settlement and the Tobacco Carveout.

Speaker Profile: Mr. Ratan Singh, Director, Chartered Institute of Arbitrators (India)

Mr. Ratan Singh, Director, Chartered Institute of Arbitrators (India) and Chairman, Society of Construction Law, UK (India) will be moderating Panel Discussion II: Transparency v. Confidentiality: Finding Middle Ground in Perceived Contradictions on October 15, 2016.

Mr. Singh sits as arbitrator and has either chaired or participated as tribunal member or counsel in various domestic and international arbitrations. He is a regular speaker at various events organized by the Permanent Court of Arbitration, ICC and the Nani Palkhiwala Arbitration Centre. He is also on the editorial board of the law reporter: Recent Arbitration Judgments (RAJ).

Mr. Singh will be discussing the issue of procedural transparency as contrasted from confidentiality obligations amongst parties as well as those of the arbitrator, and the purpose and effect of the Mauritius Convention.

Mr. Shashi K. Dholandas, Associate General Counsel, TheJudge Limited, will be moderating Panel Discussion III: Institutional Arbitration In India: Past, Present And Future on October 16, 2016.

Mr. Dholandas is Associate General Counsel with TheJudge Limited, an independent Third Party Funding and Insurance broker specializing in international arbitration. He has previously served as a Director and International Case Counsel with the ICDR and ICDR Canada, where he has administered over three hundred disputes involving parties and arbitrators from around the world. He is also a guest lecturer on arbitration at Rutgers Law School.

His work profile includes having advised arbitrators and parties on legal and administrative aspects of complex international arbitral procedure under the various rule-sets of the ICDR, ICDR Canada, and the AAA; review and revision of Tribunal issued emergency, interim, and final awards to ensure clarity, scope, and enforceability; and preparation of memoranda and recommendations on jurisdictional objections, arbitrator disqualifications, and rule interpretation. In his present capacity, he thus oversees all ICDR cases having a Canadian nexus. He is also Co-chair of the ICDR Practice Moot and Lecture Series.

Mr. Dholandas will be discussing the lessons that India can learn from the American Arbitration Association and Canada, in its move towards furthering institutional arbitration.

Mr. Lalit Bhasin, President, the Society of Indian Law Firms, is the Chief Guest at the Inaugural Ceremony of the CARTAL International Conference: Arbitration at Crossroads.

Mr. Bhasin is the President of the Bar Association of India, Chairman of Chartered Institute of Arbitrators (India Branch), Executive President of the India Law Foundation and Managing Partner of Bhasin & Co. He was awarded Honorary Membership of the International Bar Association, Melbourne in 1994 for outstanding service to the legal profession. He has also been awarded the Plaque of Honour by the Prime Minister of India for outstanding contribution to the Rule of Law.

Mr. Bhasin shall be delivering the Inaugural Address on October 15, 2016.

Mr. Promod Nair, Founding Partner at Arista Chambers, Speaker at Panel Discussion IV

Mr. Promod Nair, Founding Partner at Arista Chambers, shall be speaking at Panel Discussion IV: Overhaul of India’s Arbitration Law: Critiquing The Amendment Act (October 16, 2016).

Mr. Nair is a member of the London Court of International Arbitration, Vice-President of the Indian Arbitration Forum, and also a Member of IJAL’s Board of Advisers. He has considerable experience acting as counsel in commercial and investment treaty arbitrations, having conducted arbitrations in various jurisdictions in Europe and Asia. Mr. Nair is also an awardee of the Clive Parry Prize in International Law, from the University of Cambridge.

Mr. Nair will be discussing Sections 9 and 17 of the Arbitration and Conciliation Act, 1996, the regime for costs, and time limit for awards along with the problems this may create with institutional rules, on Panel Discussion IV.

Mr. James P. Duffy IV, Partner at Baker & McKenzie LLP, shall be delivering the Keynote Address at the Inaugural Ceremony on October 15, 2016.

Mr. Duffy is a partner at the firm’s New York office; his practice focuses on international arbitration and related litigation. He has over 15 years of experience in international arbitration and international litigation in complex commercial and investor-state disputes, as well as in formulating global dispute resolution strategies. He has represented clients across a range of industries in international arbitrations administered under the ICC, AAA/ICDR, LCIA, HKIAC, SIAC, DIAC, JAMS, GAFTA, ICSID and UNCITRAL rules in the US, Europe, Asia, Africa and Latin America. His practice has a strong geographic focus on the MENA region, the Indian sub-continent and East Asia.

Introducing one of our main speakers at Arbitration at Crossroads, Hon’ble Mr. Justice Arjan Kumar Sikri

We are pleased to introduce one of our main speakers at the event, and Keynote Speaker on October 16, 2016: Judge, Supreme Court of India.

Justice Sikri was appointed to the Delhi High Court in 1999 and also served as Chief Justice of the Delhi High Court from October 2011, before being elevated as the Chief Justice of Punjab & Haryana High Court in 2012. In 2013, he was elevated to the Supreme Court of India.

Justice Sikri’s specialization ranges from constitutional, labour and service law cases to, more recently, arbitration matters. He has also chaired numerous national and international seminars and workshops, and is known for his strong opinions on how India needs to make progressive strides towards becoming a favoured arbitration venue. His notable arbitration pronouncements include his concurring opinions in the Reliance – Panna Mukta arbitration on arbitral challenge; and the Shailesh Dhairyawan v. Mohan Balkrishna Lulla decision on appointment of substitute arbitrators.

Justice Sikri will be moderating Panel Session 4, the topic of which is “Overhaul of India’s Arbitration Law: Critiquing the Amendment Act Of 2015”.
